Not automatically. The law considers contributions (financial and non-financial, including caring for children) and future needs β€” the result is what's fair, not necessarily equal.

Is super included?

Yes. Superannuation is treated as property and can be split between you.

Is there a time limit?

Yes β€” generally 12 months from a divorce, or 2 years from a de facto separation. Get advice before those run out.

Do we need court?

Often not. Most settlements are reached by agreement and made binding by consent orders, without a hearing.
